Dear learned brothers and sisters in Islam
At a recent debate amongst friends the discussion on whether and animal is halaal to eat if shot and killed by a rifle arose.
W.R.T. the above, Halaal as we understand is the cutting of the reciting of Neath, slicing of the throat and letting of all the blood ( in a nut shell ) as per quote from this very web site.
1) Asalam Alaikum
The Prophet (Sallalahu Alaihi wassallam) said:
أُحِلَّتْ لَنَا مَيْتَتَانِ وَدَمَانِ فَأَمَّا الْمَيْتَتَانِ فَالْحُوتُ وَالْجَرَادُ وَأَمَّا الدَّمَانِ فَالْكَبِدُ وَالطِّحَالُ
Two kinds of dead meat and two kinds of blood have been permitted to us. The two kinds of dead Meat are fish and locusts, and the two kinds of blood are the liver and spleen Ibn Majah 2) Firstly Saying the name of Allah is a condition of meat being halaal, and it is not excused by forgetting or not knowing, according to the most correct scholarly opinion. Secondly:
Meat slaughtered by one of the people of the Book (a Jew or a Christian) is permissible subject to two conditions: 1 – That the meat be slaughtered as a Muslim does it, by cutting the throat and esophagus and letting the blood flow. If the animal is killed by strangling or electric shock or drowning in water, its meat is not permissible. Similarly, if a Muslim does that, the meat is not permissible."
The question then is, if an animal is shot and dies before being reached to perform the above is that animal still halaal for consumption. Can reciting the neath before pulling the trigger be regarded as sufficient to make the animal halaal.
In an article from another web site the following is quoted
" http://www.sunniforum.com My question is for Shafi'ie users on this forum, why does your madhhab forbid using firearms for hunting and what is the rationale for this? Also, the Prophet [sallallaahu alaihi wasallam] permitted hunting and eating animals by saying the name of Allah and then releasing the hunting dogs, or saying the name of Allah and then shooting your arrow to kill the animal. Firearms are basically just a modern version of the bow and arrow, so how could it be haraam to hunt with them?!"
NOTE: Hunting with a bow and arrow is not the same as hunting with a gun, with a gun the animal normally dies instantly if the shot is placed properly and therefore there is no time to perform the above "ritual" where as with an arrow you may still have sufficient time to do so.
Please advise Shukran
